My son was in a car accident last April. He was backing out of a parking spot in his high school parking lot. Kid came flying by, cutting through the parking lot and my son backed into him. My son was found to be 100% at fault for the accident. The damage to my son's car was $3600, the damage to the other kid's car was around $4000, so it was a major accident, which meant 4 steps on my son's license. His insurance went up over $500 a year for the next 7 years.
I appealed the decision based on a few factors-my son was not more than 5 feet out of his parking spot. The bumper of my son's car was ripped off and thrown 25-30 feet in the direction the OTHER kid was driving. It was raining, which reduced visibility and there were 2 larger cars parked on either side of my son's car, which limited his vision...he was inching out slowly when the other kid came flying by.
We got the decision today and WE WON!!!
All the points will be removed from my son's license and we get the money back that we paid for all the surcharges-$500+!!!
Anyone know what happens with the deductible that we had to pay when we got his car repaired? It was a $500 deductible....it'd be really nice to get that back too!!

I only recently learned that even if you get hit while backing up, it is your fault. The way people fly up & down parking lot aisles is ridiculous, I say that is total BS. If you can show you were being careful & watching... why should it be your fault.

That was the point in us fighting it. The other kid was using the parking lot as a cutthrough from street to another-he wasn't even parked in that lot. And he was going way too fast-driving on it as though it were a street-as evidenced by my son's bumper flying 30 feet in the direction the kid was heading.
Anyways-I'm just so glad it worked out.
7 years of $500 surcharges.....$3500 is alot of money.
